By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.
This website is operated by Parker Mountain Machine and Armory (“PMM”). Throughout the site, the terms “we”, “us”, “I” and “our” refer to PMM. PMM offers this website, including all information and services available to “you”, “the user”, “the customer”, and the “purchaser”, conditioned upon your acceptance of these terms, conditions, and policies stated here.
By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms and Conditions”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services. We reserve the right to refuse service to anyone for any reason at any time.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
Parker Mountain Machine and Armory (“PMM”) reserves the rights to change these Terms or to remove or change the contents on this website from time to time at its sole discretion. These Terms will be governed by and construed in accordance with the laws of the United States of America, without giving effect to any principles of conflicts of laws.
Cancellation of an order not shipped will result in a 6% charge for credit card transaction fees. Please be sure you are ordering the correct part for your needs when placing your order. SHIPPING & BILLING ADDRESS:
Due to fraud, all orders must have matching shipping and billing addresses. If your order needs to be shipped to a separate address from your billing address, please provide that information to customerservice@parkermountainmachine.com We will require a copy of photo ID. If photo ID is not provided, PMM will cancel your order. Cancellation of an order will result in a refund less a 6% transaction fee.
PMM is not responsible for orders not received due to an inaccurately inputted address.
You may return new, unopened, and unused items within 30 days of receiving. All components of the product are necessary in order to be eligible for return. All returns are subject to a 10% restocking fee, less shipping. The customer is responsible to cover return shipping costs. Please allow 1-3 business days for refunds to be initiated upon PMM receiving the item for return.
Exchange Policy:
Exchanges must be new and unopened/ unused, and purchased within the last 30 days. The customer is responsible to cover return shipping costs. Please contact customerservice@parkermountainmachine.com with your order number and details to assure that we are able to accommodate your request.
Products and Services:
These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
Industry Regulatory Disclosure Requirements:
Any and all serialized and ATF-regulated items, as required by federal law, will only be shipped to a verified Federal Firearms License holder. They are responsible for complying with all federal, state and local laws when processing your background check and transfer of the item/s. If you are unsure of what your local and state laws and regulations are, please call your local ATF office prior to purchasing. Your local ATF office will be able to inform you of what restriction/s affect you, if any. They will also be able to inform you of what the requirements are for finalizing a transfer in your state.
Federal Firearms Licensees (FFLs):
- Handguns: Under federal law, FFLs may not sell, deliver or otherwise transfer a handgun or handgun ammunition to any person the transferor knows or has reasonable cause to believe is under the age of 21.
- Long Guns: Under federal law, FFLs may not sell, deliver or otherwise transfer a long gun or long gun ammunition to any person the transferor knows or has reasonable cause to believe is under the age of 18.
Limitation of Liability:
PMM shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if PMM has been advised of the possibility of such damages. PMM does not assume responsibility for misure or improper installation of any product.
PMM shall not be liable for the unlawful use or application of any of its products. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.
PMM’s customers are responsible for knowing Federal, State and Local laws and regulations applicable to them, and following them accordingly. If you are unsure of what your local and state laws and regulations are, please call your local ATF office prior to purchasing.
Possession and sale/resale of products sold on this website are subject to federal, state, and local laws, including U.S. export regulations. By making a purchase from this website, the purchaser represents and warrants that the purchaser 1) is at least 18 years of age; 2) is not prohibited by federal, state, or local law or regulation from purchasing or possessing a firearm or the products purchased from this website; 3) will comply with all applicable federal, state, local laws and regulation, and will not provide any product purchased from this website to any person who is prohibited by federal, state, or local law or regulation from possessing or receiving the product; and 4) will not export, sell, transfer or otherwise dispose of any product purchased from this website in any other country without first obtaining approval from the U.S. government or as otherwise authorized by U.S. law and regulations. Typographical Errors and Accuracy:
In the event that a PMM product is mistakenly listed at an incorrect price, PMM reserves the right to refuse or cancel any orders placed for products listed at the incorrect price. PMM reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, PMM shall issue a credit to your credit card account in the amount of the stated incorrect price.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
Modification to the Services and Product Prices:
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of any services or products.
Barrel Work Lead Times:
Lead time on barrel work is a MINIMUM of 12 weeks. This means in the best case scenario you will receive your barrel 12 weeks after PMM has received it. We appreciate your patience. If you do not agree with these terms, please do not place an order for custom barrel work.
Optic Cut Slide Machine Work Lead Times:
Lead time on slide machine work is a MINIMUM of 6 weeks. This is only for the machining. Coating services offered by PMM are performed by third parties, and PMM can not guarantee the lead time on these services. Approximate lead times are provided on the product pages. If you do not agree with these terms, please do not place an order for an optic cut.
PMM Limited Lifetime Warranty:
PMM offers limited lifetime warranty on PMM made products. PMM does not assume responsibility for misuse, improper installation, or purchase of incorrect products. The customer assumes all liability and responsibility with the proper care of firearms and related items. All PMM products are guaranteed from original manufacturing defects and anomalies. PMM cannot extend this warranty to products not purchased from PMM or an authorized PMM dealer. Please email customerservice@parkermountainmachine.com for warranty.
Termination:
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by PMM without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.
Notice:
PMM may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to PMM.
Miscellaneous:
Your use of this site shall be governed in all respects by the laws of the state of New Hampshire, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of PMM products) shall be in the state or federal courts located in Strafford County, New Hampshire. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of PMM products) must be commenced within one (1) year after the claim or cause of action arises. PMM’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. PMM may assign its rights and duties under this Agreement to any party at any time without notice to you.
Use of Site:
Harassment in any manner or form on the website, PMM email, PMM social media or by telephone, is strictly forbidden. Impersonation of others, including a PMM or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
